The BC Government should have as a motto, “We hate nature.”, or “Uglifying British Columbia”, as this is what their actions indicate. And on top of this, they are using the “First Nations Band Chiefs”(government puppets) to accelerate the destruction of our environment. Part of this is of course exacerbated by the incompetence with handling the Pine Beetle situation which is out of control. The picture at the left – the brown section indicates what the forests looks like after Pine Beetle infestation. Further complicating the situation, according to my sources, is that people who did Pine Beetle remediation on the promise of funding are having to go to court to get the money promised from the government. The way things are going BC could become a huge desert. Did you know that many of the big deserts in the world used to be forests? Ow.

There is that old Chinese saying, “May you live in interesting times.” We can safely say that these times are ‘interesting’, to say the least.

In the case of this Writ, submitted by Hereditary Chief Kiapilano of the Squamish Nation, it is literally going to be a watershed in land claims negotiations.

This writ was submitted on behalf of the Squamish Nation people as they had learned that the Band Chiefs were about to sell off some more of their territory (See Judocracy Inspiration 2), when leasing was not only the preferred method for two key reasons:

1) The Squamish Nation would retain all of the rights guaranteed by the Royal Proclamation of 1763 and the Indian Act; and
2) With a 99-Year lease, the Nation would make quite a bit of money as well as the leased property reverting back to the Nation at the end of the lease.

Curiously, the Band Council got wind of this Writ and filed their own Writ a couple of days later, with a significantly reduced map of the Nation. It kinda makes you wonder who they’re working for…

So, for your inspection, please see the different pages of the Writ:

Today, June 29 was the initial hearing on a Writ of Claim issued by Hereditary Chief Kiapilano (Capilano) in response to attempts by the Squamish Nation Band Chiefs Bill Williams and Gibby Jacobs to sell off Squamish Nation reserves against the will of its people.

Fortunately, Chief Kiapilano and his associate Harriet Nahani/Nahanee were able to delay a decision because of Judge Parrot’s order on the case as the lawyers representing the Band had only provided their position the day before.

In case you didn’t know, as most people don’t, sections of the Nation have been sold off without the knowledge and/or consent of the 3,000 + members of the Band.

Of course, you can’t just blame Band Chief Williams and Jacobs, as the initial sale of the land where Park Royal North sits was made in 1957. Most Indians did not notice this until 1972, when they got taxed just like non-Indians.

It’s curious that someone would have sold off the land, then there was allegedly a 99-year lease on the property, which makes a lot more business sense. Kinda like not selling the golden goose, eh?

So, there is a campaign afoot to get this information to the members of the Squamish Nation who will likely want to continue to enjoy the benefits of their status which was guaranteed by the Queen through the Royal Proclamation of 1763.

Just so you can see this situation which changed from 1957 to the present day, check out these images, one from 1973, and the other from the present. Note that the upper-left corner where Park Royal North is unshaded, indicating it’s no longer the property of the Squamish Nation :(

On a positive note in this day, a rail blockade was called off as CN agreed to urge the federal government to settle outstanding claims.

So, yes, change is possible, but sometimes you have to get tough, eh?

Yes, we live in a judocracy, of the lawyers by the lawyers for the lawyers ;)

However, the people still have their say and their influence. And the lawyers know this.

How so? Well, on June 23, 2006, the Supreme Court of British Columbia decided to postpone action on the potential extradition of John Graham to the United States to stand trial for the alleged murder of Anna Mae Aquash.

Frankly, the reason why there is this delay in deciding that has come as a result of heavy support from the community of people who understand the implications of this case.

But, in the interest of not “re-inventing the wheel”, you might just review the information on the John Graham Defense Committee website.

So, if you value your human rights, sovereignty and whatever else you hold dear, take the time to write a letter to the Minister of Justice, Vic Toews and let him know how you feel.
